PRIVACY POLICY

THIS PRIVACY POLICY (“AGREEMENT”) CONSTITUTES A LEGAL AGREEMENT BETWEEN YOU AND [NAME] (“[DEFINED]”) AND DESCRIBES THE TERMS AND CONDITIONS APPLICABLE TO USE OF PERSONAL INFORMATION IN CONNECTION WITH THE SITE AND SERVICES (COLLECTIVELY THE “SITE”) AVAILABLE UNDER THE DOMAIN AND SUB-DOMAINS OF [DOMAINS]. THE ABOVE NAMED PARTIES ARE HEREIN REFERRED TO SINGULARLY AS A “PARTY” AND COLLECTIVELY AS THE “PARTIES”.

BY ACCESSING, VIEWING, OR USING ANY PART OF THE SITE OR BY SUBMITTING ANY PERSONAL INFORMATION, INCLUDING EMAIL ADDRESSES AND TELEPHONE NUMBERS, TO THE SITE, YOU ACKNOWLEDGE THAT YOU HAVE READ AND AGREE TO BE BOUND BY THE TERMS AND CONDITIONS CONTAINED IN THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT ACCESS, VIEW, OR USE ANY PART OF THE SITE OR SUBMIT ANY PERSONAL INFORMATION THIS AGREEMENT SHALL BE GOVERNED BY THE ELECTRONIC SIGNATURES ACT, AND THE USER’S AGREEMENT TO THE TERMS OF THIS AGREEMENT SHALL BE MANIFESTED BY ANY ACCESS TO, VIEWING, OR USE OF THIS SITE.

THE MATERIALS CONTAINED IN THIS SITE MAY INCLUDE EXPLICIT VISUAL, AUDIO, OR TEXTUAL DEPICTIONS OF NUDITY AND SEXUAL ACTIVITIES AND IS DESIGNED AND INTENDED SOLELY FOR ADULTS, PEOPLE WHO ARE AT LEAST EIGHTEEN (18) YEARS OF AGE, OR TWENTY-ONE (21) YEARS OF AGE IN PLACES WHERE EIGHTEEN (18) YEARS OF AGE IS NOT THE AGE OF MAJORITY, WHO ARE INTERESTED IN AND INTENTIONALLY AND KNOWINGLY SEEKING ACCESS TO SUCH MATERIALS FOR THEIR OWN PERSONAL VIEWING FOR ENTERTAINMENT OR EDUCATIONAL PURPOSES.

YOU ACKNOWLEDGE AND AGREE THAT BY ACCESSING, VIEWING, OR USING ANY PART OF THE SITE OR BY SUBMITTING ANY PERSONAL INFORMATION, YOU CONSENT TO RECEIVE COMMERCIAL MESSAGES AND COMMUNICATIONS FROM THE SITE, ITS ADVERTISERS, AFFILIATES, SPONSORS, OR ANY THIRD PARTY FOR ANY MARKETING, ADVERTISING, OR COMMERCIAL PURPOSES WHATSOEVER.

I FURTHER CONSENT TO AND AUTHORIZE THE SITE, AS EVIDENCED BY MY CHECKING THE CHECKBOX BELOW, TO SELL OR PROVIDE WITHOUT MONETARY CONSIDERATION ANY PERSONAL INFORMATION I SUBMIT TO THE SITE TO ANY PERSON, COMPANY, ADVERTISER, AFFILIATE, SPONSOR, OR ANY THIRD PARTY WILLING TO PURCHASE OR RECEIVE SUCH INFORMATION FOR ANY MARKETING, ADVERTISING, OR COMMERCIAL PURPOSES WHATSOEVER.

1. [DEFINED] collects information in different ways throughout the various parts of its Site. This information is used to provide a customized experience as you use the Site and to enable delivery, operation, and maintenance of the Site, Content, and materials contained therein, including without limitation, to enable delivery of commercial messages and communications to you from the Site, its advertisers, affiliates, sponsors, or third parties, to provide accurate customer and technical service, to respond to inquiries and troubleshooting, to ensure proper delivery of Content and billing information, to provide specific services as requested or subscribed for, to protect the security of the Site and network resources, to ensure compliance with local, state, or federal laws, regulations, or statutes, to ensure compliance with this Agreement and other policies governing use of the Site, and to maintain records. 2. You must at all times maintain the confidentiality of your user or account information and passwords, if applicable. If you are a corporation, partnership, or other legal entity, you may allow employees to use such information, provided you are responsible for all activity by such employees.

3. Permitting use of the Site by a third party is prohibited and is a violation of this Agreement. If there is a breach of security through your user or account information, you must immediately notify [EMAIL]. You will be liable for any unauthorized use of the Site until you notify us of the security breach.

4. [DEFINED] may provide links to third party sites. The third party site may ask you to provide personal information, such as name, address, email address, phone number, and credit/debit card information. [DEFINED] has no control over any third party site’s use of any personal information you provide to such third party site under any circumstances. Please exercise extreme care when providing personal information to a third party site.

5. [DEFINED] may display online advertisements and may share aggregated and non-identifying information about Users collected at the Site, as well as through online surveys and promotions with these advertisers. Additionally, in some instances, this aggregated and non-identifying information is used to deliver tailored advertisements.

6. [DEFINED] may periodically conduct User surveys. Users are encouraged to participate in these surveys because they provide important information that assists in improving the Site. Personal Information submitted as a response to User Surveys may be shared with third parties. Participation in User surveys is voluntary.

7. Information received from responses to User surveys may be combined, or aggregated, with the responses of other [DEFINED] Users to create broader, generic results to the survey questions. The aggregated information may be used to improve the quality of the Site. This aggregated, non-personally identifying information may be shared with third parties.

However, you may opt out or otherwise prohibit such unrelated uses by submitting an opt out notice as provided in Section 14. Additionally, [DEFINED] may disclose personal information about Users, or information regarding your use of the Site or third party sites accessible through the Site, for any reason if [DEFINED] believes, in its sole discretion as permitted by law, that it is legal, ethical, and reasonable to do so in order to:

(A) satisfy laws, such as the Electronic Communications Privacy Act, regulations, or governmental or legal requests for such information;

(B) disclose information that is necessary to identify, contact, or bring legal action against someone who may be violating the terms and conditions of this Agreement;

(D) protect the Site and its Users.

9. A “cookie” is a small data file that can be placed on your computer’s hard drive when you visit certain Internet sites. [DEFINED] may use cookies to collect, store, and sometimes track information for statistical purposes to improve the Site and to manage networks and systems. Cookies may also be used to save Site settings and provide customizable and personalized Site services. Additionally, be aware that if you visit third party sites where you are prompted to log in or that are customizable, you may be required to accept cookies.

10. Advertisers, third parties, and partners may also use their own cookies. [DEFINED] does not control use of these cookies and expressly disclaim responsibility for information collected through them.

11. Please remember that any information you may disclose in public areas of the Site or the Internet, becomes public information. You should exercise extreme care when deciding to disclose personal information in these public areas.

12. The Site has security measures in place to protect the loss, misuse, and alteration of the information under its control. While [DEFINED] makes every effort to ensure the integrity and security of its network and systems, it cannot guarantee that these security measures will prevent third-parties from illegally obtaining this information.

13. I hereby swear, certify, and affirm, under the penalties of perjury pursuant to 28 U.S.C. § 1746 that I:

(A) am eighteen (18) years of age or older; and, if applicable;

(B) am authorized to sign for and bind the individual, corporation, partnership, or other legal entity that will be using the Site;

(D) am not under the influence of any drugs, alcohol, or mind altering substances or mechanism, natural or otherwise, nor is your judgment impaired by any mental illness, deficiency, or infirmity;

(E) do not find scenes or images depicting or involving nudity, actual or simulated sexual conduct, or sexually explicit material, actions, or circumstances to be offensive or objective in any way and are not offended by such scenes or images or by viewing the engagement, participation, and performances by others contained in such material;

(F) am not prohibited by any local, state, or federal authority or community from possessing, viewing, or performing in such material as described in 2.2(C); and

(G) acknowledge, understand, and agree that providing a false declaration under the penalties of perjury is a criminal offense and that this document constitutes an un-sworn declaration under federal law.

14. In the event you request to unsubscribe, you will no longer receive commercial messages and communications from the Site. However, you will be required to unsubscribe to any other third party Sender that has received your email address as a result of the consent to the provisions hereof.

You acknowledge and agree that if you do not evidence your consent by checking the checkbox below your email address will not be added to the Site's database and you will not receive commercial messages and communications from the Site. You may, however, receive transactional or relationship messages from the Site, as that term is defined by law.

16. You may ignore transactional or relationship messages noting an unconfirmed subscription. If you do do not confirm your subscription, your email address will not be added to the Site's database and you will not receive commercial messages and communications from the Site.
